Using Bankruptcy for Foreclosure Defense or to Stop Auto Repossession Proceedings | Chapter 7 Liquidation | Chapter 13 Reorganization

If you have lost your job, gone through a divorce or incurred substantial unreimbursed medical expenses, you may be behind on your mortgage payments or unable to make your car payments. If you face the threat of foreclosure on your home or the repossession of your vehicle, a personal bankruptcy filing can put an immediate stop to all legal proceedings and help you get a fresh financial start. We can help.

At the law office of Bruce H. Williams, Esquire, in Voorhees, we have provided comprehensive bankruptcy counsel to individuals in New Jersey for more than 35 years. We have built our reputation and practice on a strong commitment to personal service and attention. We recognize that your case is unique and will listen closely to your story so that we can learn the details of your situation, as well as what you need to move forward with your life. Mr. Williams is a former IRS Trial Attorney who can protect your interests in court if necessary.

At our office, every prospective client receives a free initial bankruptcy consultation. For an appointment, contact us online or call our office at 856-795-0800.

Bankruptcy Can Stop Foreclosure and Repossession

When you hire us to help you protect your home or vehicle through a bankruptcy filing, we will move quickly, gathering all necessary information so that we can immediately file your petition. Once your bankruptcy papers have been filed, an automatic stay immediately goes into effect, prohibiting your creditors, including mortgage lenders or auto finance companies, from calling, writing or taking legal action to collect any amounts due.

As part of our counsel, we will help you fully evaluate your situation to determine whether keeping your home or car is feasible in the long run. We will help you create a plan to cure your mortgage arrears inside the bankruptcy while making your current mortgage payments outside the bankruptcy during a three-to-five-year period. Then when you have completed your Chapter 13 bankruptcy plan, you will have paid off any mortgage arrears. We can also help create a plan to pay off your auto loan arrears or even the balance due on your auto loan within a Chapter 13 bankruptcy. Additionally, we will work to eliminate all other unsecured debts so that when you come out of bankruptcy your house payment is affordable.

If you have been notified of a foreclosure proceeding, but your home has not actually been sold at a foreclosure sale, we can use a bankruptcy filing to suspend the foreclosure process. With respect to repossession, even if your vehicle has been taken back, we may be able to recover it for you.
